Summary
The Energy Performance Buildings
Directive requires that Energy Performance Certificates
will need to be provided for all buildings when
they are constructed, sold or rented.
It will be illegal to market
a Domestic property without a Home Information
Pack (HIP) from the 31st May 2008. At present,
as long as you have instructed a HIP provider
you can market a property. Should you be asked
for a copy of a HIP, the Estate Agent should provide
a copy within 14 days of your request. HIP's enable
the prospective purchaser to examine details of
searches and makes them aware of the Energy Rating
including fuel bills. This can speed up the process
from initial offer to exchange of contracts as
the buyer's Solicitor will have access to the
majority of the data required to complete the
purchase.

advised us today 13th March 2008 that “Currently
the transitional arrangements allowing ‘first
day marketing’ expire on 31st May 2008.
It is possible that the Government may extend
this. The Government has not yet announced the
details for the introduction of Energy Performance
Certificates on rental properties other than the
target date of the 1st October 2008.”
